Employment - National Origin, Race, or Color

  • CP v. "Automotive service store," employment, national origin. CP alleged he was called derogatory names based on his national origin daily by the business' new manager. CP states his employment was terminated when the new manager held him to a higher standard than other employees. Prior to the investigation beginning, the CP brought forward several witnesses supporting his allegations. Within one month after filing his complaint with the Human Relations Commission, the manager was transferred out of the Sioux Falls store. A settlement agreement was reached during mediation where the CP received $8,500 and a positive letter of recommendation.

  • CP v. "Automotive parts store," employment, national origin. CP alleged he was called derogatory names based on his national origin daily by coworkers and the manager. When the CP complained to his manager, the manager told him that he should not be offended because he was more American than true "Beaners" (a derogatory name used for Hispanics of Mexican descent). CP also alleges he was given a less desirable work schedule and denied time-off benefits that his coworkers were given. CP alleges his employment was then terminated based on his national origin. A settlement agreement was reached during mediation where the CP received $10,000 and a positive letter of recommendation.
  • CP v. “Construction company,” employment, race. CP alleges he was subjected to race-based harassing comments, then terminated after a minor injury. CP alleges the termination was based on his race.  Settled for $2,500 and CP would no longer have a workers' compensation claim.
